- "The Customer", "You", "Yourself"
Where used, these terms represent the individual consumer who is entering into a contract with the company Fashion4Eyes.
- "We", "Us", "Our"
The company Fashion4Eyes, of Suite 207, 20 Winchcombe Street, Cheltenham, GL52 2LY, trading online at www.Fashion4Eyes.co.uk.
- Customer Obligations
- The Customer must be over the age of 16 and legally entitled to purchase prescription spectacles.
- The Customer must not be registered partially sighted or blind.
- For the supply of prescription eyewear, the Customer warrants that purchasing prescription eyewear online is legal in their country of residence.
- The Customer must have had an eye-test within a 2 year period and provide correct details of the prescription that is required. All prescriptions that are used must have been issued by a registered medical practitioner or registered ophthalmic optician.
- The Customer agrees that all details provided, including address, contact details and payment details are up to date and correct.
- We are not liable for any wrongly entered information provided by the customer with regard to the ordering of the prescription lenses.
- Fashion4Eyes will rely fully on the prescription given.
- In the event of any query, either before or after the supply of glasses, the Customer agrees to supply Fashion4Eyes with a copy of their most recent prescription.
- Unless your optician or medical practitioner has given you your PD (pupillary distance) to complete your order fully, we will use an appropriate average PD - which is set at 63 for us to complete your order. By agreeing to these terms and conditions, and unless you state otherwise, you the customer will be agreeing for Fashion4Eyes to use an average PD. Fashion4Eyes would however recommend that you consult your optician to obtain your PD before ordering, so that you can place the correct measurement on your order form.
- Availability and Description of goods
- All goods advertised for sale on the website are subject to availability. If for any reason an item required by a customer is unavailable they will be informed immediately either by e-mail or by telephone and offered a replacement item.
- Items that cannot be supplied to the Customer will not be charged to him/her. We will not be responsible for any loss to the customer or damages incurred through the non-delivery of any goods.
- All items advertised on the website are an accurate as possible description of the item supplied to the Customer.
- Photographs are for illustrative purposes only, and there may be slight variations between these and the product itself.
- Pricing
- Prices displayed on the Website are correct as of time of display.
- We reserve the right to alter prices without notice. This does not however affect customers who have made payment for any item prior to the change in price.
- All ophthalmic (spectacle) frames are priced to include a pair of premium single vision lenses with both an anti-scratch and anti-glare (anti-reflective) coating. The lenses that are included in this pricing must have spherical powers between +4.00 and -6.00 Dioptres, with a cylinder power between +2.00 and -2.00 Dioptres. All prescriptions exceeding this range will require specially made (surfaced) lenses and an extra charge will apply for this. Where the customer chooses to take advantage of a free tint on their lenses, this will be applied to the lenses instead of the anti-reflective coating. Adding an anti-reflective coating is still possible, which will improve the lenses, but will incur an extra charge.
- Certain sunglasses that are displayed on our website can also be made to your prescription. These are priced to include a pair of lenses that fall within the prescription range outlined in point 4.iii above. These lenses will be treated to provide total UV400 protection, and tinted to give a close match as possible to the colour of the original lenses in the frame.
- In the case of any prescription product outlined in points 4.iii and 4.iv above, the Customer may elect to purchase the frame without any prescription lenses. For standard ophthalmic (spectacle) frames, the frame will then be supplied with "demonstration" lenses - these lenses will often have the manufacturer's name on, and are not suitable for wear. If you wish to wear glasses purely for aesthetic purposes, you should select plano (0.00) powered lenses for each eye. Sunglass products will be supplied with their demonstration lenses in as well and due to the nature of these lenses, they can be worn as-is.
- All prices displayed are inclusive of UK VAT, which currently stands at 17.5%. UK VAT is charged on all sales.
- Payment information
- Payment must be made by the Customer at the time of ordering.
- We accept payment through PayPal and through Barclaycard ePDQ for the Customer's safety and convenience. All transactions are carried out through a secure server to protect your private data.
- In accordance with our privacy policy, Fashion4Eyes will not store your Credit Card details.
- All Credit Card payments are subject to authorization by the Card issuer. If authorization is declined then we are not liable for the non-delivery of any ordered items.
- Any use of a Customer's Credit Card is entirely at the Customer's own risk. We cannot accept responsibility for any misuse of a Customer's Credit Card.
- Items will be dispatched to the customer only once the payment has been received.
- All payments must be made in GBP Sterling.
- Postage and packaging
- Postage and packaging is free of charge to UK customers. However this is subject to change.
- For customers based outside of the UK please consult our shipping.php policy for our current charges.
- Delivery of Goods
- All items will be delivered to the customer after payment has been received and to the address specified by the customer on the order form.
- All items will be delivered in the quickest time possible. However we cannot be held responsible for any delay in delivery of any product whether caused by Fashion4Eyes or any other third party.
- If for any reason at all (not due to Fashion4Eyes' part) you do not accept delivery of the goods in accordance with this paragraph then we may charge you an additional fee to cover any reasonable direct costs.
- Once the customer has received the item any damage incurred is the responsibility of the customer.
- Upon delivery of the goods, the customer should inspect them carefully. If for any reason the goods are damaged or the order is incomplete, please contact us to inform us of the problem and do not use the goods.
- Inside each delivery will be confirmation of the prescription, if the prescription stated does not match the prescription ordered, please contact us immediately.
- Fashion4Eyes will not pay the customer's costs for any return of products. To eliminate the risk of a return getting lost in transit, and therefore not being eligible for a refund, the customer should use a method of returning the goods to Fashion4Eyes whereby the customer can obtain proof that the goods have been sent by the customer and received by Fashion4Eyes. Fashion4Eyes will not issue refunds for any return of goods, which do not arrive at the "Returns Address".
- Statutory Rights
- If for any reason the customer is unsatisfied with the item that they have ordered then they have 14 days in which to return the item in question. For further information on this, please consult our shipping.php policy, which also forms part of these terms and conditions.
- The Statutory Rights of the Customer remain unaffected by these clauses.
- Warranty and Liability
- We do not accept any responsibility and will not be liable for any damage to the goods caused by the customer once the item has been received.
- We shall not be liable to any person for any damage or loss that may arise from the use of any goods advertised on our site.
- Without any prejudice to the customers statutory rights, all the information and materials contained in this website (including, without limitation, text, graphics and links) are provided on an "as is" basis with no warranty. We do not represent or warrant that the information accessible via this site is accurate, complete or current or that the use of this site will be uninterrupted or error-free.
- In no circumstances will Fashion4Eyes or its employees, agents or subcontractors be liable to you the customer for any business interruption, loss of use, loss of data, loss of profits, contracts, goodwill or anticipated savings.
- Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury resulting from our negligence or any breach of the statutory implied terms as to title of goods or for fraud or any other liability which by law we are not permitted to limit or exclude.
- Our maximum liability (and that of our employees, agents or subcontractors) to you in connection with any physical damage caused to your property through the negligence of us (or our employees, agents and subcontractors) will not in any circumstances exceed £10,000
- In all other cases, our total liability (including our employees, agents and subcontractors) whether in contract, tort (including negligence) and breach of statutory duty or otherwise will not exceed the price of the goods and services to which the claim relates.
- General
- Any failure by us to enforce any of these terms and conditions shall not affect our right to enforce the rest of these terms and conditions.
- These terms and conditions are subject to change at any time without prior notice to the customer.
- These terms and conditions shall be governed by and construed in accordance with English Law.
- All items listed on the website are subject to availability.
- We reserve the right to refuse to sell any item to any customer, as we deem fit.
- The Fashion4Eyes Website, and all logos and images thereon are Copyright and are either the possession of the original holder or of Fashion4Eyes.
- Only you the customer can benefit from this contract. You the customer cannot transfer your rights or benefit from this contract to any other person without the prior permission of Fashion4Eyes.
- Fashion4Eyes' website does not provide medical diagnosis for any person and must not be used as a substitute for professional medical advice. Any medical questions must be directed to your registered Ophthalmic Optician.
- Resale of Goods
- All goods are sold on the condition that they are for the personal use of the customer, and are not to be resold to the public.
